Scope of Service

destinationlab provides a cloud-based software platform for travel companies to manage proposals, itineraries, traveler portals, supplier coordination, payments, and internal operations. Access is provided on a subscription basis under these terms.

Account Registration

To use the platform, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Each user must have a unique login. Sharing credentials across multiple people is not permitted.

Subscription & Billing

Subscriptions are billed monthly or annually, as selected during signup. β€’ Prices are quoted per active user per month β€’ Annual plans are billed upfront with a 20% discount β€’ All fees are non-refundable except where required by applicable law β€’ We reserve the right to adjust pricing with 30 days written notice Seat-Based Billing & Peak Usage Your subscription is priced per active team member (seat). We apply a peak-usage billing model within each billing period: β€’ When you activate a new user, the seat count increases immediately and your subscription is updated at the next billing cycle or prorated for the current period β€’ When you deactivate a user, access is revoked immediately, but the seat remains billed for the remainder of the current billing period β€’ You will always be charged for the highest number of active seats reached during a billing period This policy ensures fair pricing that reflects your actual peak usage. You can manage active users at any time in the User Management section of your admin panel.

Free Trial

New accounts receive a 14-day free trial with access to all Professional plan features. No credit card is required during the trial. At the end of the trial period, you may select a paid plan to continue using the service. If no plan is selected, your workspace will be preserved in read-only mode for 30 days.

Acceptable Use

You agree to use the platform only for lawful purposes related to your travel business operations. You may not: β€’ Reverse-engineer, decompile, or attempt to extract source code β€’ Use the platform for competitive benchmarking β€’ Store or transmit malicious code β€’ Exceed published rate limits or abuse API access β€’ Resell access without a written agreement

Data Ownership

You retain full ownership of all data you upload to the platform, including customer records, booking data, supplier information, documents, and traveler communications. We process your data solely to provide the service and in accordance with our data protection policy. Upon account termination, you may export your data within 30 days.

Intellectual Property

The platform, including its design, source code, algorithms, documentation, and branding, is the intellectual property of destinationlab GmbH. Your subscription grants you a non-exclusive, non-transferable license to use the platform during the term of your subscription.

Service Level

We aim for 99.9% uptime for Professional plans and 99.95% for Enterprise plans. Scheduled maintenance windows are communicated in advance and do not count against uptime. Refund credits for SLA violations are calculated based on the monthly subscription fee for the affected period.

Support

Support is provided according to your plan level: β€’ Starter: Email support (next business day) β€’ Professional: Live chat with a 4-hour response SLA β€’ Enterprise: Priority support with a 1-hour SLA, dedicated account management, and phone support

Termination

Either party may terminate a subscription with 30 days written notice. We may suspend access immediately if you violate these terms or fail to make payment within 14 days of a due date. Upon termination, your data remains accessible in read-only mode for 30 days, after which it may be permanently deleted.

Limitation of Liability

To the maximum extent permitted by law, destinationlab's total liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.

Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms shall be resolved in the courts of Berlin, Germany. For EU consumers, mandatory local consumer protection laws may also apply.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email and in-app notification at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
